You do NOT need to restate the facts described above. However, you WILL want to refer to any and all facts you use in your analysis of the problem.
Make sure you properly identify each section of your IRAC answer by letter or label, for example “I” or “Issue,” “R” or “Rule,” and so forth.
Because there are two questions that you must answer there are perhaps a couple of ways you can structure your submittal. One would be to label the section and then list each question under, for example:

“Question #2”
Alternatively, you could provide a full IRAC answer to Question #1, then provide a separate full IRAC answer to Question #2, for example:
