recording, write a short reflective note on the skills you developed from the
role play or observed, referring to the skills that a mediator needs to conduct
mediation effectively.
Your reflective writing should make reference to an

2. Explain how the courts in England and Wales encourage
alternative dispute resolution, in particular mediation, and whether a party
involved in pending civil court proceedings would be able to legitimately
refuse mediation?

You are required to support your explanation by reference to
relevant legal authority, both primary and secondary sources.
For question 2 please explain where the courts in England
and Wales can encourage in ADR in particular mediation, so explain how the
courts do so, look at implied compulsory mediation.
The second element is whether any parties involved in court proceedings
whether they would be able to legitimately refuse to engage in a form of ADR
such us mediation.
Focus only on these 2 elements for question 2
Define what ADR  is,
give a bit of background that’s encouraged by the courts, references, legal
authority, whether it comes from secondary sources or primary sources, then
explain how the courts encourages it
