Identify employee rights under the OSH Act based on the following situation.
An employee made a legitimate safety complaint with OSHA. OSHA must keep the employee’s name anonymous when they notify the employer of the complaint. Remember that OSHA can either address the complaint with an on-site inspection or by notifying the employer in writing. In either case, the employer is required to address the complaint issue. 
Before filing the complaint with OSHA, the employee had been issued a final warning for absenteeism. As part of that final warning, the employee received a “job in jeopardy” notification. A “job in jeopardy” notification informs the employee that another absence within a specific time frame will result in termination. 
The employer received a written notification from OSHA noting the complaint was from an employee. The notice must be posted in the workplace for at least three days or until the issue is resolved, whichever is longer. Upon seeing the notice, the employee admitted to the supervisor as being the one that filed the complaint. The employee did not report to work the next day, which was Friday. He did report to work the following Monday.
Decide what, if any, action(s) management should take. 
Employees have several “rights” under the OSH Act. 
Identify two of those rights, and in two to three sentences, describe those rights.
Employees also have several responsibilities under the OSH Act, such as complying with all OSHA regulations and the employer’s safety rules. 
Identify and briefly, in two to three sentences, describe two responsibilities employees have under the OSH Act.
